Navigating the site ensoshisha.ro followed by placing an order implies reading, understanding, and accepting the terms below by any Customer.

ensoshisha.ro reserves the right to change and update the content of this site, as well as the Terms and Conditions of use, at any time without prior notice.

In case of discrepancies or misunderstandings between ensoshisha.ro and the Customer, the Terms and Conditions valid at the time of the Order will apply.

1. Definitions

User – any person who visits the site ensoshisha.ro.

Customer – a natural person/legal entity placing an Order.

Products and Services – any product or service mentioned in the Order, which is to be provided by the Seller to the Customer.

Order – an electronic document that acts as a form of communication between the Seller and the Customer, through which the Customer expresses the intention to purchase certain Products and Services and make payment for them.

Seller –TSF FULFILL LOGISTIC S.R.L.., hereinafter referred to as "ensoshisha.ro," with the following identification details: Unique Registration Code RO44284338 , registered with the Trade Registry under numberJ40/8666/202 with its headquarters located at Strada Ciobanului no. 5, Mogosoaia, Romania.

Contract – an Order confirmed by the Seller, through which the Seller agrees to sell and deliver the Products and Services and the Customer agrees to purchase, receive, and pay for these Products and Services.

Courier – any public or private person providing express courier services.

1. Intellectual Property Rights

The content of the site ensoshisha.ro: images, texts, web graphics, scripts, software, design rights, model rights, patents, trademarks, is the exclusive property of ensoshisha.ro and its suppliers and is protected by Copyright Law and intellectual and industrial property laws. Unauthorized use of any of the elements listed above is punishable according to applicable law. ensoshisha.ro and the ensoshisha.ro logo are registered trademarks of ensoshisha.ro.

ensoshisha.ro may grant the User/Customer, through an agreement, the right to use certain content from the site in a described manner. This agreement strictly applies to the defined content, for a period specified in the agreement, and only to the person(s) allowed to use this content, without allowing the use of other content from the ensoshisha.ro site.

The use of any registered trademark on ensoshisha.ro does not constitute an endorsement of that company. ensoshisha.ro assumes no responsibility and cannot be held liable for damages resulting from the use of the site’s content.

ensoshisha.ro reserves the right to cancel Orders for Products and Services displayed on the site due to technical errors or if, due to technical errors, the prices displayed are evidently incorrect/derisory for products (prices that any average buyer may reasonably consider incorrect/derisory).

ensoshisha.ro, as the organizer of promotional campaigns, assumes no responsibility for the loss or damage of campaign vouchers, is not responsible for counterfeit or damaged vouchers, and reserves the right to cancel the voucher used for purchase or to deduct its value from the refund amount in the event of a return according to the law of a product participating in that campaign.

1. Access Restrictions

Users of the ensoshisha.ro site may make comments and any other communications, send suggestions, questions, or information, as long as their language is civilized, and the content of their communications is not illegal, obscene, threatening, defamatory, does not infringe on the privacy of others, does not violate intellectual property rights, does not contain viruses, is not related to promotional campaigns unrelated to ensoshisha.ro, is not mass emails or any other form of spam. Persons who use a false email address or send electronic messages or any other communications on behalf of another individual or entity will be reported to the competent authorities. ensoshisha.ro assumes no responsibility and cannot be held liable for any damages caused by such communications.

In the case of sending or posting materials/documents involving texts, replies, reviews, etc., formulated by Users, it is considered that the User guarantees their originality and grants ensoshisha.ro and its affiliates/associates the non-exclusive, unlimited, free, irrevocable, and transferable right to use, reproduce, modify, adapt, publish, translate, create derivative works, and distribute, present these contents worldwide by any means. The User guarantees that they have all rights to the content they post or transmit on the site, so that its use does not harm any third physical or legal entity.

1. Processing of Personal Data

The categories of personal data processed are: name and surname, gender, date and place of birth, civil status data, phone/fax, address (residence), email, profession, workplace, professional training, family situation, economic-financial situation, data regarding owned goods, habits/preferences/behavior, image, voice, geolocation/traffic data.

When a User creates an account on ensoshisha.ro, they will receive commercial communications from ensoshisha.ro only to the extent that they have given their express consent by selecting the corresponding option.

The data collected regarding newsletters and alerts is confidential. ensoshisha.ro will be able to select the Users to whom it will send newsletters and alerts.

According to Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of these data, as amended and supplemented, and Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, ensoshisha.ro is obliged to process personal data provided by Users under secure conditions and only for the specified purposes.

The purpose of collecting personal data is: economic-financial management, advertising, marketing, publicity, statistics, electronic communication services, informing Customers about their account status on ensoshisha.ro, informing Customers about the evolution and status of Orders.

Completing forms on the site by Users implies unconditional acceptance that this data will be included in ensoshisha.ro's database and used and processed by ensoshisha.ro, its affiliates, and collaborators for the activities listed above, including but not limited to marketing service providers, courier services, payment/banking services.

Customers are guaranteed the rights provided by Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of these data, namely the right to information, the right of access to data, the right of intervention, the right to object, the right not to be subject to an individual decision, and the right to address the court in case of violation of their rights. Customers have the right to request the complete or partial deletion of their personal data. The Customer may request any of the above rights by submitting a written, signed, and dated request to the headquarters of Enso Shisha.

Failure to provide this data results in the impossibility of fulfilling Orders.

If the Customer changes their personal data already provided to ensoshisha.ro using the forms on the site and there are Orders in progress, the Orders will retain the data from the time of the Order placement, and the delivery of the products will be made considering the newly modified data.

ensoshisha.ro does not request confidential information, bank account details, personal passwords, etc., from its Users through any communication means (phone/email, etc.). If the User discloses such information to third parties, they bear full responsibility for their actions. Thus, in cases of such data disclosure, the User cannot hold ensoshisha.ro liable for any damages.

1. User Registration

To create an account on the site ensoshisha.ro, the User is required to use a valid email address. ensoshisha.ro may refuse the registration request in cases where it finds that the information provided is inaccurate or the services are used in a manner inconsistent with normal practices.

1. Price

The final price paid by the Customer consists of the product price + shipping and/or collection costs. Delivery charges are detailed on the site.

All prices for products and services sold through the ensoshisha.ro site are expressed in Lei and include VAT (19%).

8. Order

To activate the "One-click Order" service, the User must set their preferred Order details (delivery address, shipping method, and payment method) in their User account, and these settings will be saved and used for each One-click Order. These settings can be modified at any time.

By completing the Order, the Customer guarantees that all provided data is accurate and correct; otherwise, they may face consequences such as delays or incorrect orders.

ensoshisha.ro cannot be held liable for erroneous information that may result in delivery delays. In this context, all shipping costs for the redelivery of the Order will be borne by the Customer.

By finalizing the Order, the Customer agrees that a representative of ensoshisha.ro may contact them through any agreed-upon means (email/phone) to personally confirm the Order.

(This email is merely a confirmation of receipt of your order request. Your purchase contract for these products is not fully concluded until we send an email notifying you that the products have been shipped.)

For the Customer's convenience and safety, there is an option to cancel the Order within 30 minutes after placing it. Therefore, if a User places an Order by mistake or changes their mind, the Order can be canceled within 30 minutes of placing it. For payments made by card, the final payment amount will only be deducted from the Customer's account after the 30-minute period.

ensoshisha.ro may refuse an Order following prior notice to the Customer, with no obligations between the parties and no claims for damages by either party, in the following situations:

• Failure/invalidity of the online transaction;
• Non-acceptance by the Customer’s card-issuing bank/transaction;
• Incomplete or incorrect Customer data;
• Customer activity causing damage to the ensoshisha.ro site/partners;
• Consecutive failed deliveries;
• Other objective reasons: if the Customer cannot guarantee that the payment method is valid and not obtained through fraudulent means or there are suspicions regarding the payment method.

Even though all measures have been taken to ensure the accuracy of the information presented on this site, ensoshisha.ro cannot be held responsible for inaccuracies that may occur when the Customer completes the forms on the site for Order finalization. Users are responsible for assessing the accuracy, completeness, and usefulness of the information provided in the forms available on this site.

In certain situations and for justified reasons, ensoshisha.ro reserves the right to modify the quantity of Goods and/or Services in the Order. In such cases, ensoshisha.ro will inform the Customer at the email address or phone number provided to the Seller at the time of the Order and will refund the amount paid.

The contract is considered concluded between the Customer and ensoshisha.ro when the Customer receives from ensoshisha.ro, via email and/or SMS, the notification of Order shipment.

If a Good and/or Service ordered by the Customer cannot be delivered by ensoshisha.ro, we are obligated to inform the Customer of this fact and to refund the Customer’s account for the value of the Good and/or Service within a maximum of 14 days from the date ensoshisha.ro becomes aware of this fact or from the date the Customer explicitly expresses their intention to terminate the Contract.

9. Billing – Payments

The price, payment method, and payment terms are specified in the Order. The Seller will issue an invoice to the Customer for the delivered Products and Services, and it is the Customer’s obligation to provide all necessary information for the invoice issuance according to the applicable legislation.

Payment can be made online (card or PayPal) or by cash on delivery.

10. Warranty

For products purchased from the online store ensoshisha.ro, warranty is provided in accordance with the Warranty Certificate for each product. The legal entity providing the warranty is the one mentioned on the product's Warranty Certificate.

To benefit from the warranty, the Customer has the following obligations:

• The product must have been purchased from ensoshisha.ro and used only for its intended purpose;
• Follow the usage instructions and use the product according to the manufacturer’s instructions;
• Keep the warranty certificate and the fiscal document with which the product was purchased;
• Retain the original packaging and all accessories that came with it, and deliver them along with the product under warranty.

The location for warranty service is specified on the Warranty Certificate. Unless otherwise specified, the cost of transportation is borne by the Customer. Reasons for loss of warranty include:

• Mechanical damage or deterioration;
• Excessive exposure to solar radiation;
• Missing or altered serial numbers;
• Product modifications;
• Damage caused by failure to follow usage, transport, handling, and installation instructions in the user manual;
• Flooding, fire, exposure to sunlight, electrical discharges, inappropriate modifications or installations, unauthorized interventions;

ensoshisha.ro does not provide warranties to Customers:

• If the purchased product does not meet the Customer’s requirements or expectations;
• After the warranty period offered by the Seller has expired;
• If replacement of non-compliant products or components is impossible, including due to lack of equipment or technology.

All other provisions of the applicable legislation regarding the warranty of sold products are valid. The Customer’s rights are those provided by the relevant legislation. The warranty does not extend to any damage caused by the use of the product.

11. Delivery

The estimated delivery date may vary depending on the product and is displayed on the product page, in the Order page, and in the Order confirmation email or phone call.

For all product categories, the maximum delivery term is 14 days from the date of Order confirmation.

For Customers abroad, the final price of the Order will be communicated by email, and delivery will be made after explicit acceptance of this price.

For products in stock, delivery will be made according to the Customer’s choice, by Courier or personal pickup (options available on the order completion page). There is a 12-24 hour interval between Order registration and Courier pickup. Any additional delays will be communicated to the Customer, and a new delivery date will be agreed upon, which cannot exceed the maximum term stated above.

Attention! Due to the very short processing time of Orders, it is impossible to make changes to Orders that have already been placed.

If products are unavailable (including if the price or certain features of the products have changed after Order confirmation), ensoshisha.ro will inform the Customer of the unavailability, and the amounts paid will be refunded within 14 days. The Customer may confirm changes regarding the price or features of the products, thereby modifying the original Order, and ensoshisha.ro will deliver the products according to the modified Order.

For out-of-stock products, the Customer agrees that ensoshisha.ro may deliver a product with equivalent qualities and price to those requested. If the Customer exercises their right to unilaterally terminate the contract within 14 days of receiving the products, the return costs of the products are borne by the Customer.

In cases where the Customer places an Order containing products from different suppliers regarding delivery, these will be considered separate packages and will be indicated as such on the site in the Order page. They have different delivery terms. The shipping fee applies to each package individually.

11.1 Delivery Conditions

At the request of ensoshisha.ro or the Courier, the Customer must provide proof of identity, if necessary, by one or more documents issued by official authorities and communicate the Order number assigned by the Seller.

If the Customer is unable to receive the Order personally, the Order will be left at the specified address only to a person over 18 years old and only if the Courier is provided with the Order number.

No delivery request will be fulfilled if the Customer does not meet the above conditions.

In the case of delivery to the Customer’s workplace, where the Courier cannot access the location, the Customer must ensure they can receive the Order.

The Customer will be contacted by the Courier by phone in advance to confirm their presence at the address and time selected at the moment of Order validation on the site.

The Customer is obliged to be present at the delivery address during the selected time frame; otherwise, they will bear the cost of transportation for a possible new delivery. The time frame can be changed later only with the Courier’s agreement.

Delivery is considered fulfilled by ensoshisha.ro at the moment the ordered products are handed over to the Customer at the address selected by them at the time of placing the Order.

11.2 Receipt of Products

The Customer is obliged to sign the delivery receipt (AWB) presented by the Courier at the delivery of the ordered products, which is also accompanied by the fiscal receipt containing all information about the delivered products (product name, quantity, price). The Customer will also check if the products are damaged or if there are any shortages, and any issues will be noted in handwriting on the delivery receipt to be considered.

By signing the delivery receipt, the Customer acknowledges receipt of the ordered products in good condition and in full.

12. Promotional Campaigns

12.1 Promotional Codes

Promotional codes offered by ensoshisha.ro through any promotions are valid exclusively for the section mentioned in the email containing the code, unless otherwise specified. It is important to note that some products are categorized as "Exceptions," for which promotional codes cannot be applied, and they must be purchased at the price displayed on the site. Promotional codes can only be used at the time of placing the Order; they cannot be used to reduce the value of the Order after it has been placed.

Only one promotional code can be used per Order; the Order page does not allow the use of multiple codes in the same Order. For eligibility for a promotion, the value of shipping is not considered, unless specified otherwise. Promotions related to free or reduced shipping costs apply to each delivery.

If a promotional code has been applied to an order that could not be fulfilled or was canceled for any reason, the Customer has the right to request the reactivation of that promotional code exclusively in writing, via email to shishaenso@gmail.com, including the order ID, its status, the Customer's name, and the promotional code. These can be reactivated for a maximum period of 30 calendar days.

Attention! Promotions on ensoshisha.ro cannot be combined; the highest discount will apply. This applies to all forms of discounts (loyalty cards, promotional codes, gift vouchers, percentage discounts on the site, etc.) as a rule, unless specified otherwise in the promotion. Additionally, in the case of percentage vouchers, the holder of such a voucher cannot benefit from the combined discount given by applying the percentage voucher to an already existing discount within a promotion. Certain promotional campaigns cannot be combined with other discounts, promotions, or loyalty actions. This is specified in the regulations of the respective campaign.

ensoshisha.ro unilaterally establishes or collaborates with certain suppliers to set the rules for promotions and contests organized on ensoshisha.ro, which are published exclusively on the site. Promotions apply to orders that fully comply with the rules displayed on the site, within the clearly mentioned validity period, and subject to stock availability. ensoshisha.ro does not guarantee stock availability for the entire promotion period and may withdraw the promotion without prior notice.

12.2 Suspension of the Promotional Campaign

In the case of a promotional campaign organized by ensoshisha.ro, the organizer reserves the right to suspend the promotional campaign at any time during its course, with prior notification to consumers through appropriate communication channels (website display, in-store signage, etc.).

The organizer reserves the right to modify any of the conditions set forth in the campaign regulations during the campaign period for justified reasons, but not before informing the public of these changes.

12.3 Vouchers / Coupons / Promotional Codes

12.3.1 General Provisions

Voucher = promotional code, promotional coupon.

Each voucher is identified by a voucher code and has various requirements to be valid and applicable. Please carefully check all details and information on the voucher to ensure the discount is granted.

The value of each voucher is specified on it.

Shipping and handling fees apply to any purchased product, regardless of its value unless otherwise specified in promotions, regulations, etc. Therefore, if a voucher imposes a minimum purchase value for products, shipping, handling fees, etc., also apply to those products. A voucher cannot be used to pay for shipping fees, delivery charges, handling, or other services, unless otherwise agreed.

Every item, regardless of promotion, will have a minimum value; ensoshisha.ro cannot sell products with a zero value.

The Customer will pay the tax required by law depending on the promotion.

Vouchers are only valid if used on the ensoshisha.ro website.

Vouchers prohibited by law will be considered null.

Vouchers are not intended for resale and cannot be converted into cash.

Vouchers cannot be replaced if lost, stolen, or destroyed.

All provisions related to fraud mentioned on the ensoshisha.ro website fully apply to voucher fraud, and any attempt at fraud will be reported to the competent authorities.

12.3.2 Application Conditions

Each voucher will be limited such that multiple vouchers from a single IP address/same address are not allowed.

Any promotion involving discount vouchers is limited to one voucher per individual or legal entity (identified as a customer/user).

Each voucher is limited to a single use and is valid for a limited period, as specified in the terms and conditions, in the voucher offer email, and in the "vouchers" section of the user account, or as stated in each individual promotion/offer. ensoshisha.ro reserves the right to modify or cancel these vouchers at any time, with prior notice to customers.

No voucher can be applied to other promotions/offers except those strictly mentioned in the respective offer.

If the products for which the voucher was issued and for which the customer qualified for the promotion are not purchased, the voucher cannot be applied. For example, vouchers issued for certain products that are subsequently canceled/returned by the customer cannot be considered valid; they only apply as a discount to those products actually paid for.

The voucher only applies to products/categories explicitly mentioned as eligible in the promotion. Products excluded from the promotion are communicated in terms and conditions or in certain regulations or special offers in the "exceptions" section. These exceptions include products that by law cannot be sold at a discount.

Promotional offers cannot be combined within the same order. Only one discount voucher can be used per order.

In orders containing multiple products, the discount voucher value is allocated to each product based on the weighted value of that product within the total order value, excluding shipping fees.
